Terms & Conditions

Please read these Terms and Conditions carefully before ordering any products from our website. Any purchase made is conditional of your acceptance of these terms.

1. Definitions and Interpretation.

“Contract” – A contract for the purchase and sale of products.
“Dispatch Confirmation” – Our acceptance and confirmation of your order.
“Goods” or “Products” – The goods/products sold by us via our website.
“Order” – Your order for Goods;
“We/Us/Our” – means Lloyd and James Chocolate, 26 Fore Street, Torquay, TQ1 4LY

2. Information About Us

Our website www.lloydandjameschocolate.co.uk is wholly owned and operated by Lloyd and James Chocolate.

3. Intellectual Property

All content included on our site is our property in accordance with UK intellectual property laws. You may not reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on our site without written permission from us.

4. Goods, Pricing and Availability

Every effort is made to ensure that descriptions and photos of the Products on our website correspond to the actual Products received. However, please note: Our Products are handmade in small batches, therefore there may be slight variations in colour, writing style, packaging or shape.

5. Allergens

All our Products are made in a kitchen where we use nuts (including peanuts), sesame, soya, eggs, sulphites and milk. Therefore we cannot guarantee that any of our Products are free from nut traces or other allergens. More information is available on the allergen section of our website.

6. We neither represent nor warrant that Goods will be available.

7. Pricing

Every effort is made to ensure prices are correctly displayed on our website. However, if a mistake has occurred, we will contact you in writing before proceeding with your Order to inform you of the mistake. You will then have the option on how you wish to proceed.

  • Purchase the Goods at the correct price
  • Cancel the order (or the affected part thereof)

We will not process your order until you respond. If you do not respond within 14 days, we will treat it as cancelled, notify you by the email address provided on the order, and refund any monies accordingly.

7.1. All prices on the website include VAT where applicable. Delivery charges are not included in the price of Goods on Our Site. These options and related charges will be presented to you as part of the order process.

7.2. If We, for any reason, reject or are unable to fulfil your Order, no payment shall be taken under normal circumstances. If We have taken payment any such sums will be refunded to you as soon as possible and in any event within 14 days.

8. Payment

Payment for Goods and related delivery charges must always be made in advance and you will be prompted to pay during the order process. We accept the following methods of payment on Our Site: Visa, Mastercard, Amex, Paypal, Maestro, Applepay.

9. Delivery

9.1. All Goods purchased through Our Site will normally be delivered within the times given on the Site during the Order process. It is your responsibility to be available at your address to receive goods or make alternative arrangements/provide delivery instructions to the third-party courier.

9.2. Orders placed before 4pm are dispatched on the following working day from their receipt. Delivery windows apply to working days only (Mon-Fri). Orders placed over the weekend will be packed on Monday (or the next working day if it is a bank holiday), and posted the following day. Our courier does not deliver at weekends or bank holidays.

9.3. Click and Collect: Products will be ready for collection at our Premises within 48 hours of order (usually before). Customers will receive an email confirming when their Goods are available. Collection is during shop opening hours only. Currently Tuesday – Saturday, 9:30am – 4:30pm.

9.4. Last order date for Christmas deliveries is on 15th December. Please note, we close our online service from 24th December until 10th January to allow time for restocking.

10. Damaged or Incorrect Goods

By law, We must provide goods that are of satisfactory quality as described at the time of purchase, If any Goods you have purchased are damaged upon receipt, or if you receive incorrect Goods, please contact us as soon as possible to arrange for a refund or replacement. You may need to return damaged goods to us at your own expense. If this is the case, this will need to be done within 14 days of receipt of goods. We recommend you use a trackable postal service, and retain proof of postage.

Any Refunds will be issued within 14 Calendar Days of the day on which We agree that you are entitled to the refund.

11. Gift cards

Gift cards must be used within six month of issue date with no exceptions. No change is given on purchases that fall under the total value of the voucher.

12. Hot weather

We do not post our Products during unusually hot weather as the quality of our chocolate will be affected by the heat and will not arrive in good condition. If the UK temperature rises above 25 degrees Centigrade in the area the Products are being sent from or posted to, we will temporarily suspend posting them, and hold your Product unless we have in writing or email that you (the customer) wish the postage to go ahead at your own risk. The customer will be given a choice to wait for the weather conditions to ease or receive a refund.
